The judge overseeing President-Elect Donald Trump’s hush money case in New York is adjourning his upcoming November 26th sentencing. Judge Juan Merchan will still allow the defense to file a motion by December 2nd to dismiss the case altogether.
Trump lawyers have been demanding the judge throw out his conviction — writing if the case isn’t tossed it would be “uniquely destabilizing” to the country.” They claim that immediate dismissal is mandated by the Constitution, the Presidential Transition Act, presidential immunity, and Trump’s win in the 2024 presidential election.
Trump was convicted earlier this year on felony counts related to a hush money payment. Prosecutors have said they don’t mind a sentencing delay, but will challenge efforts to toss the case.
