(Redwood City, CA) — The hearing to determine if convicted killer Scott Peterson will get a new trial may not happen until next year. The California Supreme Court last year ordered a lower court to consider if a juror in Peterson’s original murder trial committed misconduct. Today, Superior Court Judge Anne-Christine Massullo heard arguments from the defense, asking to conduct depositions of that juror before the hearing to ultimately decide if Peterson gets a new trial. Prosecutors object to that plan and have until September 8th to file an opposition to the defense’s motion for discovery. Peterson’s lawyers will then have a week to reply. If their motion is granted, the discover process could take up to 60 days. The judge said that could mean the hearing won’t happen until after the holidays.
