Supreme Court Weighs Elected Officials Blocking Constituents

The supreme court is weighing in on a social media issue that started in the San Diego neighborhood of Poway.  Can you sue an elected official for blocking you on social media?  Long story short, it depends. 

The Supreme Court ruled on Friday that if the social media account is acting as “state action” that is, in an official capacity for the constituents, then yes. If the account is more of a personal account, then no. 

The tricky part is determining the nature of the account, since some of them serve as a combination of both.  O

ne of the two cases that brought this issue to the Supreme Court came from a lower court ruling about the Poway Unified School Board.  In that case, members of the board blocked some parents after posting critical comments on the board’s public Facebook page.
