A state appeals court has rejected a request for re-sentencing a gang member who was convicted of shooting at LAPD Officers.
The three-justice panel from California’s 2nd District Court of Appeals found that Rodrigo Perez must continue serving his 40-year-to-life sentence in a state prison.
His attorneys wanted the sentence reviewed under the context of California’s new law that allows for some attempted murder suspects to receive lighter sentences and in some cases early release.
In 2005, Perez shot at police officers who were outside his apartment in the Hollenbeck neighborhood. One officer was wounded in the hand.
