The Supreme Court’s refusal to hear the case means the current legal status of homeless people sleeping on the street will not change. At issue is a case that started in Boise and was ultimately decided by the 9th Circuit Court of Appeals. That federal court ruled that prosecuting people for sleeping outside violates the 8th Amendment’s ban on cruel and unusual punishment. However, cities can enforce a ban if they provide enough beds.
